Any Precipe Order of Sale filed on/after September 28, 2016 will be subject to Ohio House Bill 390. Any Order of Sale filed PRIOR to the effective date of Ohio House Bill 390 will be processed according to the procedures in place at the time of the filing.

Terms of Sale: “Business Day” means calendar day not including Saturday, Sunday or Holidays.

Ohio House Bill 390 Frequently Asked Questions
  • Remote Bid: The judgment creditor or lien holder shall submit their bid by email by 4:30pm Eastern Standard Time on the business day prior to the sale date. The Sheriff shall confirm receipt via email to the Plaintiff, Judgment Creditor or Lien holder who entered the bid. All bids received after 4:30pm Eastern Standard Time on the business day prior to the sale date will be confirmed via email but NOT accepted. All other bids will be accepted at the auction. (O.R.C. 2329.152)
  • If the judgment creditor is the purchaser at the sale they shall not be required to make a sale deposit. (O.R.C. 2329.211)
  • Third party purchasers shall make sale deposit as follows:
    • If the appraised value of the residential property is: 
    • Less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).
    • Greater than ten thousand dollars ($10,000.00) but less than or equal to two hundred thousand dollars ($200,000.00, the deposit will be five thousand dollars ($5,000.00).
    • Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)
  • We will accept cashier checks only.
  • The Purchasers Information Form must be filled out at the time of auction.
  • If the property is unsold at the first auction then a second auction shall be held and the property shall be sold to the highest bidder without regard to minimum bid. But subject to relating cost, allowance and real estate taxes.
  • The unpaid balance of the purchase price must be paid to the Portage County Sheriff by cashier's check within thirty (30) days of the filing of the confirmation entry. The plaintiffs' attorney will prepare the confirmation entry and the deed. The Portage County Sheriff's Office will transfer and record all deeds within 14 days of receiving the deed, confirmation entry and final payment. The purchaser may be responsible for paying the deed, recording and conveyance fees for cases purchased at the Sheriff Sale. Sheriff Sales begin promptly at 11 a.m. in Magistrate Stephen J. Smith’s courtroom, “Courtroom C”, Ravenna Courthouse, 1st floor. The Plaintiff's attorney must provide the Deed to the Sheriff within 7 days from the filing of the confirmation of the sale. (O.R.C. 2329.36 )
